Public health exclusive responsability of the state? Aspects regarding the crisis generated by the COVID-19. The legal framework that regulates public health in Romania

The right to public health is a right guaranteed to all people, a right of major importance like the right to life, respectively individual freedom. With regard to public health, Article 35 of the Charter of Fundamental Rights of the European Union governs Health Protection. According to the article, everyone has the right to access preventive healthcare and to receive medical care under the conditions established by national laws and practices. A high level of human health protection shall be ensured in the definition and implementation of all Union policies and activities.
